16.110.010 Subdivision variances.
Whenever the tract to be subdivided is of such unusual size or shape or is surrounded by such development or unusual conditions that the strict application of the requirements contained in this title would result in real difficulties or substantial hardship or injustice, the commission may grant a variance waiving such requirements so that the subdivider may develop his property in a reasonable manner. Any variance shall include findings identifying the physical attributes of the property and any unusual conditions which justify a variance. A variance shall be the minimum required to provide substantial relief. The commission shall consider protection of the public welfare and interests of the borough and surrounding areas, and may condition approval of a variance under this section on such requirements as necessary to protect the public interests of the borough and surrounding areas and to ensure that the applicable provisions of state and federal law are complied with and the general intent and spirit of these regulations are preserved.
