Leased borough real property shall be utilized for purposes within the scope of the application, the terms of the lease, and in conformity with the borough comprehensive plan. Utilization or development for other than the allowed uses shall constitute a violation of the lease and subject the lease to cancellation. Failure to commence construction of the proposed improvements within two years or failure to complete construction of the proposed improvements within five years of the date of lease shall be a breach of lease and shall, at the borough’s option, result in termination of the lease unless the borough has granted an extension under the terms and conditions set forth in KIBC 18.20.130.
